Courts-Martial for May 2014 Published June 19, 2014 By 35th Fighter Wing Legal Office MISAWA AIR BASE, Japan -- The following courts-martial recently convened at Misawa Air Base: U.S. vs. Tech. Sgt. Johnny B. Smith, Jr. On May 19, 2014, Technical Sergeant Johnny B. Smith, Jr., 35th Civil Engineer Squadron, was convicted at a General Court-Martial convened at Misawa AB, Japan, by a military judge. Sergeant Smith pled guilty to, and was convicted of, two specifications of Dereliction of Duty, three specifications of Making a False Official Statement, and two specifications of Larceny. Between March 17, 2009 and September 28, 2012, now Staff Sergeant Smith misrepresented his dependency status to finance so that he could receive Basic Allowance for Housing above and beyond what he was entitled to. To receive that money, Sergeant Smith falsely filled out several finance documents listing his ex-wife and a child not in his custody as his dependents. The Military Judge sentenced Smith to 6 months confinement, reduction to the grade of E-5, and the performance of hard labor without confinement for 3 months.
