Legal Blotter - 3nd Qtr 2016 Published Jan. 24, 2017 By 35th Fighter Wing Office of the Staff Judge Advocate MISAWA AIR BASE, Japan -- During 2016’s 3rd quarter, five Misawa Airmen received nonjudicial punishment under Article 15, Uniform Code of Military Justice. Commanders used the following as a means of punishment, rehabilitation, and maintaining good order and discipline. Nonjudicial Punishments (Article 15): A senior airman received a suspended reduction to the grade of E-3 and a reprimand for one violation of Article 134, UCMJ, adultery. An airman first class received a reduction to the grade of E-1, 30 days restriction to the limits of Misawa Air Base, 7 extra duty days, and a reprimand for one violation of Article 91, UCMJ, Strike/Assault a superior NCO; and two violations of Article 134, UCMJ, Drunk/Disorderly; discredit to service and fleeing scene of accident. A technical sergeant received a suspended reduction to the grade of E-5, forfeiture of $228.00 pay, and a reprimand for one violation of Article 87, UCMJ, missing movement; and one violation of Article 92, UCMJ, dereliction of duty. A staff sergeant received a suspended reduction to the grade of E-4 and a reprimand for one violation of Article 134, UCMJ, Drunk/Disorderly; discredit to service. A staff sergeant received a suspended reduction to the grade of E-4, forfeiture of $1,241.00 pay per month for two months, 45 days restriction to the limits of Misawa Air Base, 45 extra duty days, and a reprimand for one violation of Article 134, UCMJ, other offenses under Article 134. Discharges: An airman basic received an Under Honorable Conditions (General) Administrative Discharge for Misconduct: Pattern of Misconduct. A senior airman received an Under Honorable Conditions (General) Administrative Discharge for Misconduct: Minor Disciplinary Infractions. An airman first class received an Under Honorable Conditions (General) Administrative Discharge for Unsatisfactory Performance: Failure to Progress in Military Training. An airman first class received an Honorable Discharge for Unsatisfactory Performance: Failure to Meet Minimum Fitness Standards. A senior airman, three airmen first class, and an airman received an Honorable Administrative Discharge for Conditions That Interfere with Military Service: Mental Disorders. Misawa Civilian Adjudication Program (MCAP): A juvenile DoDEA dependent was issued 120 hours of community service, a 365 day suspension of AAFES privileges, and fines and fees as a result of a second shoplifting offense at the AAFES Main Exchange. A juvenile DoDEA dependent was issued 30 hours of community service, a 90 day suspension of AAFES privileges, and fines and fees as a result of a shoplifting offense at the AAFES Main Exchange. A juvenile Air Force dependent was issued 30 hours of community service, a 180 day suspension of AAFES privileges, and fines and fees as a result of a shoplifting offense at the AAFES Main Exchange. A juvenile Air Force dependent was issued 16 hours of community service (in addition to two citations from Security Forces and the subsequent points) as a result of allowing an unlicensed driver to drive, and failure to wear a seatbelt. An adult Air Force dependent was issued 15 hours community service (in addition to seven citations from Security Forces and the subsequent points) as a result of failure to maintain JCI; liability insurance; and Road Tax.
